The following Terms and Conditions serve as the Agreement governing the visitor's use of Sainima's website at www.sainimamoana.co.nz and any Reiki Service obtained from Sainima. The parties to this Agreement include "The Company" which we may refer to as "Sainima", "Sainima Moana", "The Company", "This Service", "we", "us", "our" or "her" and the visitor to this website, who we may refer to as "you" or "your". 

These Terms are effective from 10 April 2020 and replace any and all earlier Sainima Moana Terms and Conditions contained in any document used by you and purporting to have contractual effect. 

By accessing, viewing, or using this site, you acknowledge that you have read, understand, and agree with these Terms and Conditions. If you do not wish to be bound by these Terms and Conditions, please do not use this website or obtain any Reiki service from Sainima. 

The Company reserves the right to change these Terms and Conditions from time to time by notice, which may be in the form of a notice posted on The Company's Website. 

If The Company fails to enforce any Terms or to exercise The Company's rights under these Terms and Conditions at any time, The Company has not waived those rights. 

If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these Terms and Conditions. 

Unless any provision in this agreement expressly provides otherwise, these Terms and Conditions are not intended to confer a benefit on any person or class of person who is not a party to it. Obtaining Reiki Service from this Website may only be made by persons who are acquiring Reiki Service for their own personal use, or for their Next-of-Kin/Spouse/Friend's personal use, and you must not acquire Reiki Service via the website for resupply (whether in trade or otherwise). 

The Company may deliver notices to you by sending them to an email address that you have notified to The Company. You are responsible for ensuring the accuracy of your contact details on the Contact and/or Booking forms.

DISCLAIMER: 

All Reiki sessions and Information provided on this Website and emailed to you, including The Guidelines, are intended to support Personal and Spiritual Health and Growth. They should not be used as a substitute for medical advice or treatment from a Registered Medical or Mental Health Professional. They are intended as an addition only, to Professional Health Care treatment and medication.

Always consult a Registered Medical or Mental Health Professional. If you are currently taking prescribed medication or treatment, please do not stop taking them without your Registered Health Professionals’ advice. Neither Sainima or The Company can be held responsible for any loss, claim or damage arising out of the use, or misuse of the suggestions made, the failure to take any medical advice or treatment, or for any material suggested through third parties. 

NO GUARANTEES

Sainima and The Company make no guarantees about the results you will receive. You agree that any statements made by Sainima regarding potential outcomes are opinions and are not binding on The Company. Results are dependent on many factors including but not limited to the severity of the medical condition(s), the level of compliance with The Guidelines that are emailed out, along with other factors that you or Sainima may not be able to anticipate. 

PERSONAL RESPONSIBILITY

As a Licensed Reiki Master Practitioner, Sainima does not diagnose conditions, prescribe medications, or interfere with treatments provided by your Registered Health Professional(s). Sainima agrees to take all care and Personal Responsibility in the duty of care to providing you with Reiki Service to the best of Sainima's Abilities. However, You also agree to take personal responsibility for Your own Health, during and after using Sainima's Reiki service, including but not limited to adherence of The Guidelines that is emailed out, and ensuring you take all relevant medication/treatment from your Registered Medical or Mental Health Professional. 

REIKI SESSION POLICY: 

You must be 18 years of age or over to have a Reiki session. 

The Reiki Recipient consents to Reiki being sent. 

In the event the Reiki Recipient is unable to provide consent, Next-of-Kin/Spouse/Friend's consent will suffice. 

Next-of-Kin/Spouse/Friend(s) acknowledge and accept that Reiki may not work in these instances. 

The Reiki Recipient endeavours to follow the Guidelines sent by email as best they can. The Reiki Recipient acknowledges and accepts adherence to the Guidelines as much as possible will Greatly Help with their Healing process. 

REIKI SESSION POLICY FOR MINOR CHILDREN UNDER 18 YEARS OF AGE: 

Parents and Legal Guardians may provide Parental/Guardian consent for their Dependent children who are under the age of 18, and still living at home. 

Independent children under the age of 18 who are living independently away from their Parents/Guardians are entitled to Consent for themselves.

The Guidelines sent are intended for the personal use and reference for Adult Reiki Recipients only. However, the Parents/Legal Guardians of minor children can read these Guidelines on their children's behalf in order to Help implement the Positive Changes that are needed to Help their Children with their Healing journey. Parents/Legal Guardians Acknowledge and Accept that Good adherence to the Guidelines as much as possible will Help with their Children's Healing process. When minor children are of an age where Parents/Legal Guardians deem their children are able to understand the Guideline concepts within, then these Guidelines are intended to be passed onto their children for their own use and information so that they are able to Independently Help themselves. 

PRICING: 

This Service is currently free of charge, however the Company reserves the right to introduce and alter prices at any time. 

CANCELLATION: 

You may cancel your booking at any time in writing via the Contact Form. Please advise name of Reiki Recipient. 

PRIVACY POLICY: 

The privacy of your information is important to Sainima. Through the operation of this website, The Company will collect information about you. Please find this Privacy Policy as an explanation as to what information is being collected and why. 

PERSONALLY IDENTIFIABLE INFORMATION 

The only personally identifiable information Sainima collects is that which you provide through the Contact or Booking forms. Sainima uses this information to be able to send you information you request, in order to be able to action her Reiki Service for you, and in order to send you emails regarding the Reiki Service. Sainima may also use it to conduct marketing research, to Help improve her Services. When you submit personally identifiable information to Sainima, you understand that you are agreeing to allow Sainima to access, store, and use it for these purposes. Sainima may share this information with third parties, but only to those parties whom Sainima trusts to help run her website and operation of The Company, and who agree to keep your information private and confidential. Sainima may also be required to provide this information if requested to do so by Law. 

You can request details of your personal information that The Company holds, and ask us to correct it, at any time. As required by New Zealand Tax Law, we keep your information on file for 7 years.

OPT-OUT POLICY 

If you obtain Reiki from Sainima, you will automatically receive any future updated changes to Sainima's Style of Reiki at any point in time - free of charge, including emailing you any information that she deems may be of Help to you too with regards to Self-Healing. 

If at any time you do not wish to receive these Reiki updates, or emails or any other offers from Sainima, please let Sainima know via the Contact Form. Please advise name of Reiki Recipient as well, so that the relevant Client record can be updated.

Opting out of receiving the above-mentioned Reiki updates and emails will not prevent the sending of messages that specifically relate to any Reiki Service obtained eg; The Guidelines.

The Company takes measures to maintain the security of the personal information you have provided to The Company. Even so, we cannot guarantee that all information shared through the internet will remain secure and you agree that we cannot be held responsible for a breach of our Website security that is beyond our control.

The Company owns the intellectual property rights of all information on this Website including but not limited to The Company Name, Company Logo, Original Catchphrases - "Helping You to Heal You" and "With Love I Serve You ... With Love I Serve All !!", Original Quotes - "Love! Heals All!", Writings and The Original Guidelines that are sent by email to Recipients of Sainima's Reiki Service. The Company's ownership rights are protected by copyrights and other proprietary rights. You shall comply with all Copyright Laws Worldwide in your use of this website and prevent unauthorised copying. You may not copy, display, distribute, modify, reproduce, or transmit this Website or portions thereof without prior written consent from The Company. Except as provided in this Agreement, The Company does not grant you any express or implied right in or under any patents, trademarks, copyrights, or trade secret information. 

LIABILITY LIMITATION: 

The Company will always endeavour to have complete and accurate information on our Website but to the greatest extent permissible by Law we assume no responsibility for the completeness and current accuracy of the information provided on our Website. 

To the greatest extent permissible by Law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. (For those living in New Zealand, this exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993). 

Our maximum liability to you (if any) shall be limited to the value of any service supplied by us and we, our employees, contractors and agents, will not be liable to you for loss or damage of any kind however that loss or damage is caused or arises. 

APPLICABLE LAW AND JURISDICTION: 

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside. 

Use of the Sainima Moana website, supply of Reiki Services by Sainima to you and any other matter arising from these Terms and Conditions are subject to the Laws of New Zealand. The Courts of New Zealand shall have exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these Terms and Conditions, or with the use of the Website or supply of any Services. 

Where you or any other person who you act for, or who you permit to act for you supplies incorrect information for the procurement of a service and we incur cost in any matter concerning that name then we may recover the costs incurred by us from you (including legal costs on a Solicitor - Client basis).
